It feels to me like unintended consequences are more likely then, like advertisers stop biasing where they advertise.
The lawsuit itself is clearly a loser in court, but I don't think the goal is to actually win. I think the point is the age-old tactic of dragging things out in court to maximize the monetary cost for your opponent, hoping that they'll reach a point where they'll settle with you just to stop bleeding money.
