True. But since drag shows that are "obscene for children" tend to be held late at night, in bars with alcohol, the act is also consistent with a legislative intent to harass every single person wearing a dress.

The court's decision comes down to "it'll be fine, and if the police start shutting down drag reading hour, we'll think about it then". Except that justice delayed is justice denied, and they won't step in until innocent people have spent time in jail because of spite.
