Pay-per-output? AI firms blindsided by beefed up robots.txt instructions

I don't see how this solves the problem of misbehaving companies that want to train LLMs. Isn't this just going to fall back to copyright laws if a company is found to be breaching the terms as there's no signed contract etc.
