Execs can only use E2EE for personal purposes, not business.

Well, considering an outbreak of destroyed evidence seems to be happening in the courts, with some accountability hopefully it will be an unwritten law. But of course Congress could also get involved.

Really, their written communications need to be discoverable. And it wouldn't be unreasonable to require at least notes be taken of their phone calls and meetings.
And if those calls weren't recorded, is that going to be destruction of evidence too? Where is the line drawn and who gets to say where?
to me this is like saying a casual conversation in the park is destruction of evidence just because you didn't record it
