Brussels, 01/04/2026 — FFII gifted Macron’s EU law glasses to judges of the Unified Patent Court (UPC). The group says some UPC judges have long-term eye problems and struggle to read EU law correctly, especially when it’s about their own illegal construction. The glasses are said to have “magical AI” powers to help apply EU law. The UPC recently ignored its obligation to transmit question about its own legality to the European Court of Justice (CJEU) in the Roku case, in blatant violation of art267(3)TFEU.
The UPC denied to ask a question of EU law to the CJEU in its decision of October 6th 2025 (Roku International B.V. et al. v. Dolby International AB et al., UPC_CoA_288/2025).
Roku challenged the validity of the Brussels Regulation, disputing that UPC is NOT a “common court between Member States”, as national courts were removed of their power to interpret EU law.
The CJEU found a violation of art267tfeu in the 2017’s Achmea case, where intra-EU investment courts had to interpret EU law outside of the system of National Courts.
The refusal by the UPC Appeal Court to ask a question about the validity of an EU law is a breach of art267(3)TFEU, a “For Sure” moment for the “Rule of Law” in Europe.
