Data set is provided to You under this Agreement by each of the Data Providers. Your exercise of any of the rights and permissions granted below constitutes Your acceptance and agreement to be bound by the terms and conditions of this Agreement.
The benefits that each Data Provider receives from making Data available and that You receive from Data or otherwise under these terms and conditions shall be deemed sufficient consideration for the formation of this Agreement.
Accordingly, Data Provider(s) and You (the “Parties”) agree as follows:
1. Definitions
1.1 “Data” - means information like text, images, audio, video, literary works, tables and compilations including computer databases that are protected by copyright;
1.2 Data provider - means any entity that publishes the data set as per the terms of this license
1.3 Data Set - means structured or unstructured collection of data
1.3 AI System - An AI system is a machine-based system that, for explicit or implicit objectives, infers, from the input it receives, how to generate outputs such as predictions, content, recommendations, or decisions that can influence physical or virtual environments. Different AI systems vary in their levels of autonomy and adaptiveness after deployment [UNESCO definition]
1.4 You – Means a Person exercising rights under this License
2. Rights Granted
2.1 As long as You follow the conditions in Section 3,Data provider grants You a worldwide, non-exclusive, and irrevocable (except as stated in Section 4) right to:
(a) Use the Data set for various purposes including learning by an AI system,
(b) Share the Data set
(c) Modify the data set, and
(d) Share the modified data set.
2.2 If the Data set is protected by copyright, database rights, privacy/data protection rights or other laws, the data provider also grants You and anyone else who receives the Data set under this license the right to use and share it, as long as You follow the conditions in Section 3.
2.3 No other intellectual property rights are granted or implied beyond what is specifically mentioned here.
3.Obligations:
3.1 If You use the data set for learning by an AI system or if the data set is shared or modified:
(a) The Data set (including any modifications) must be used under this licence as mandated in this Section.
(b) You must clearly indicate any changes You make to the Data set.
(c) If You share the Data set You Receive [ or enhance/ modify the data set], You must keep all original credits or attributions to the Data Provider.
(d) If this data is used for learning by an AI system, the resultant dataset shall be shared under the terms of this licence alone keeping all original credits or attributions to the Data Provider.
4. Termination
4.1 Your rights under this license will end if You violate the terms and don’t fix the issue within 30 days after becoming aware of it. If Your rights are terminated, You must stop receiving, using, and sharing the Data or any data set developed using this.
5. Disclaimer of Warranties and Limitation of Liability
5.1 Except as expressly set forth in this agreement, the data set (including enhanced data) is provided on an “as is” basis, without warranties or conditions of any kind, either express or implied including, without limitation, any warranties or conditions of title, non-infringement, merchantability or fitness for a particular purpose.
5.2 Neither you nor any data set providers shall have any liability for any direct, indirect, incidental, special, exemplary, or consequential damages (including without limitation lost profits), however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use or distribution of the dataset or the exercise of any rights granted hereunder, even if advised of the possibility of such damages.
