For signing up you need to have a GitHub account and give Bojagi certain rights to your GitHub account and repositories. Find the beta user agreement below:
1. Privacy
Our Privacy Policy applies to the use of the Bojagi Beta. By accepting this Agreement you agree to the terms of our Privacy Policy.
2. Copyrights and Ownership
The Ownership and Copyright of Bojagi remain with Jentsch / Merz. The copyright is protected by the German “Urheberrechtsgesetz”. Using the beta does not transfer ownership of the software.
3. License and Acceptable Use
By accepting this Agreement the Beta user is entitled to use Bojagi during the closed and open beta period. The Beta User may not sell, license or transfer their access. After connecting the Beta Users GitHub account with the Bojagi Beta, the Beta User is allowed to use it on any device that is logged in with this GitHub account. Reverse engineering to replicate the software is not permitted.
4. Disclaimer of Liability and Warranties
THE SOFTWARE IS PROVIDED “AS IS WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. IN NO EVENT Jentsch / Merz GbR IS LIABLE FOR DAMAGE. THIS INCLUDES BUT NOT LIMITS TO LOSS OF PROFIT, LOSS OF INFORMATION OR BUSINESS INTERRUPTION. THIS IS ALSO THE CASE IF Jentsch / Merz HAS INFORMED ABOUT THE POSSIBILITY OF SUCH DAMAGES. The state of the provided Software under this Agreement is in an early and experimental state. The software is subject to changes. During the Beta periods of Bojagi the software should not be used in production context. entsch / Merz GbR is not liable to continue development or support.
5. Confidentiality
The Beta User will not disclose any workflows, code, technical specification or any other kind of information they received and acquired during the use of the beta of Bojagi to any third party without the prior written approval of Jentsch / Merz GbR. The Beta User will handle the confidentiality of any of the above stated information to the degree you would protect your own confidential information. If not addressed only to the Beta User, the Beta User is allowed to discuss any information of the Beta Program with other users of the Beta Program in any private discussion forums supplied by Jentsch / Merz. Any information about the Software that is made public or was specifically allowed to share to third parties Jentsch / Merz GbR does not fall under this Non Disclosure Agreement.
6. Duties of beta testers
By accepting this Agreement the Beta Users agree to report any bugs, errors and flaws they discover during the use of the beta. This includes the software itself but also documentation and provided material. The reporting needs to be done in the best effort in terms of prompt and accuracy. Any changes, modifications and improvements done on basis of this feedback will be exclusive property of Jentsch / Merz GbR.
7. Fees and Costs
The use of the Bojagi beta under this Agreement is free of charge for the time of the Beta Program (see “Term and Termination” for more information about it). The Beta User is responsible for all costs and expenses that are created by or associated with the use of the Bojagi beta. If additional agreements between the Beta User and Jentsch / Merz were done, fees might apply even to the use of the software.
8. Term and Termination
The free use of the software will be terminated after the end of the beta period, unless it has been individually agreed otherwise. The end of the beta period is defined by the earliest event of the following:
(a) The initial commercial release of Bojagi as a generally available product, this is also the case if the beta had the same state as this commercial release.
(b) Expiry of the Beta Program (either manually by Jentsch / Merz GbR or automatically by a specific date)
Any party can terminate this Agreement at any time and for any or no reason. This needs to be done by providing a written notice to the other party. In case of improper disclosure Jentsch / Merz GbR can terminate this Agreement without notice, this includes violation of the Agreement’s of the “Confidentiality” section.
With the termination of this Agreement all rights and licenses granted to the Licensee under this Agreement shall terminate immediately. Any licenses granted by Jentsch / Merz GbR need to be returned (or destroyed when requested). Also all information about the beta software in possession of the Beta User needs to be destroyed.
9. Support and Maintenance
During the Beta Program of Bojagi, Jentsch / Merz GbR is not obligated to provide the Beta User with any support or maintenance for the beta version of Bojagi. In the case Jentsch / Merz GbR is providing the Beta User with support and maintenance, this has to be seen as a purely optional service. Jentsch / Merz GbR is not reliable for any result of the given support.
Jentsch / Merz GbR has no obligations to make a commercial product of the beta version of Bojagi available in the future. In case a commercial version of Bojagi will be made available, it may have different features and functionality than the beta version licensed under this Agreement.
10. Modification
This document is the entire Agreement between the Beta User and Jentsch / Merz GbR about the use of the Beta Program of Bojagi. Any other terms are rejected. No modification or waiver of this Agreement shall be valid unless they are agreed upon in written form by both parties.
11. Severability
If any provision of this Agreement is found by a court to be unenforceable, void or invalid, this Agreement shall be modified to comply with applicable law, so as not to affect the validity of any other provision of this Agreement.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. Any legal action or proceeding arising under this Agreement will be brought exclusively in the federal or state courts located in Germany and the parties hereby consent to personal Jurisdiction and venue therein.
