Why not? Effectively the USA lets state of California decide emissions controls for the country. Seems like a valid use of US style federalism.

    It's not about how laws are passed as a whole. Your point for that is right. This law in particular creates a sweeping regulatory environment that shows hypocrisy at best and at worst something that make the technology useless for anyone obeying the law. It's an "all knives must be dull" kind of a law.
