As some of my lawyer contacts pointed out, a lot of cases get settled out of court, and that data is much harder to get, but given what we know, the odds of getting sued after giving useful feedback are extremely low.

Wait, so is there no evidence because they quietly settled or because no one ever files suits? Are lawsuit filings public even if they settle out of court?

One important step I've found helpful is asking if the candidate would like to receive feedback before sharing. This should also curb the risk of litigation.
